Complimentary Published Article: Asbestos Trusts And Tort Litigation Are Still Not Aligned

For decades in asbestos litigation, personal injury law firms have been able to bring claims on behalf of their clients against two, independent compensation systems. The first is the tort system where public lawsuits are filed against dozens of corporate defendants and pursued in various state and federal courts across the country. The second is the asbestos bankruptcy trust system, which allows plaintiff attorneys to file claims against dozens of trusts on behalf of the same tort clients with little to no transparency or coordination with the parallel tort lawsuits.

California Escalates Consumer Product Focus on Microplastics

On June 20, 2025, the California Department of Toxic Substances Control (DTSC) proposed adding microplastics (MP) to its Candidate Chemicals List (CCL) under the Safer Consumer Products (SCP) Program, which aims to promote safer consumer products for people and the environment. Inclusion on the CCL is a prerequisite for designating a substance as a "Chemical of Concern" in a "Priority Product," which would require manufacturers to perform an alternatives analysis to identify safer substitutes.

New York’s First Bulk Energy Storage Request for Proposals

Developers and clean energy investors now have a major opportunity to secure long-term revenue through New York State’s first bulk energy storage solicitation. Announced by Governor Kathy Hochul on July 28, 2025, this Request for Proposals (RFP) invites participants to compete for 15- to 25-year contracts supported by the New York State Energy Research and Development Authority’s (NYSERDA’s) market-based Index Storage Credit (ISC) incentive.
