NJDEP Asks, Do You Have to Answer?

This panel will examine the evolving regulatory, legal, and professional implications surrounding the recent NJDEP methyl tertiary-butyl ether (MTBE) data request from November 2025, potentially affecting thousands of sites across New Jersey, and possibly setting a precedent for future requests.
NJDEP’s recent MTBE data requests, in support of future natural resource damage (NRD) claims, are a new attempt to gather data outside of the standard Site Remediation Program framework and existing NJDEP regulations. This attempt at circumventing the SRP process outsources labor to responsible parties and Licensed Site Remediation Professionals.
A critical portion of the discussion will address whether responses to these data requests are required under existing NJDEP regulations, including N.J.A.C. 7:26C and N.J.A.C. 7:26I. The panel will also explore the legal and contractual implications of compliance, including risks related to client confidentiality, consultant agreements, and non-disclosure obligations. Finally, panelists will consider the broader future implications of these data requests and the regulatory and legal precedent they may establish for site remediation professionals and regulated entities in New Jersey.
