About the Webcast:

Financial statements prepared in accordance with Generally Accepted Accounting Principles (GAAP) provide investors, analysts, and other users with a defined basis for conducting financial analysis and comparison among different entities. A Non-GAAP financial measure is anything other than those specified, defined, or determined by the GAAP, which can be useful in providing insight into a company’s financial performance, financial conditions, and/or cash flow. However, Non-GAAP financial measures are often company-specific, and can be problematic if they are not defined properly and accurately.

As a result, the Securities and Exchange Commission (SEC) has heightened its enforcement of Non-GAAP disclosure rules, even revising its Compliance and Disclosure Interpretations (C&DIs) relating to these measures. In this two-hour webcast, a panel of distinguished professionals and thought leaders will provide the audience with an in-depth discussion of the SEC’s revised C&DIs, covering how to avoid potential legal pitfalls.

Marc Scarcella has fifteen years of experience as an economic consultant for mass tort litigation, specializing in quantitative methods and their applications in dispute resolution and strategic litigation management. Prior to joining Roux Associates, Mr. Scarcella was a Principal at Bates White Economic Consulting and a Managing Director at Analysis Research Planning Corporation.

Mr. Scarcella has acted as a consulting and testifying expert at both state and federal levels, on a number of complex insurance coverage cases. He has developed economic models for estimating potential insurance recoveries due to environmental and product liability claims. Mr. Scarcella has applied his expertise in forecasting future loss and litigation risk to the areas of asbestos, silica, pharmaceutical, medical devices, water contamination, sports-related head trauma, tobacco litigation, and various other forms of environmental toxins and deleterious substances.

Peter R. Kelso has been at the forefront of identifying emerging litigation trends for over fifteen years. Mr. Kelso is an expert on mass tort and product liability litigation. He specializes in data aggregation and other database management services to advise clients on litigation risk. He has advised Fortune 100 companies, international insurers and reinsurers, and many of the top investment firms on Wall Street on quantifying current and future potential costs associated with litigation outcomes.

Prior to joining Roux Associates as a Principal, Mr. Kelso was a Director at Bates White as well as a Vice President at Litigation Resolution Group. His expertise extends to insurance coverage negotiations, mergers and acquisitions, liability ring fencing activities, and bankruptcy reorganizations.
