Increasingly, state and local governments are turning to the courts to shift the claimed cost burden of climate change adaptation. These governments have filed lawsuits seeking to hold energy companies liable under various tort laws (negligence, product liability, consumer protection, private and public nuisance) for the effects of climate change. In essence, they allege that the largest energy companies caused pervasive use of fossil fuels by concealing their products’ contribution to climate change. Despite early setbacks, the list of cases continues to grow.
This webinar will help attendees understand the legal and scientific issues surrounding establishing causation in climate change tort lawsuits. Our attorney panelists will explain the legal standards for establishing causation, while our economic experts will explain aspects of public goods and behavioral economics that present technical issues.
