Opioid Epidemic America

Evidence of the opioid crisis’ effect on human health is shockingly apparent in two recently released Centers for Disease Control (CDC) reports. According to the reports, for the past two years the opioid epidemic has led to a decrease in life expectancy in the United States. This decrease in U.S. life expectancy is in sharp contrast to a continued increase in life expectancy for people of other developed nations around the world. From 2000-2016, more than 600,000 people in the U.S. died from opioid-related drug overdoses.

In 2018, we have begun to see the opioid health crisis morph into a rapid rise in opioid-related lawsuits as U.S. states, cities, and municipalities have filed suits against pharmaceutical companies, distributors, pharmacies, and doctors. Much like tobacco litigation, state attorney generals and other public officials have partnered with plaintiff law firms to initiate this litigation. To date, over 100 states, cities, and counties have filed lawsuits against various players of the opioid industry.

Roux is proud to announce the addition of a new practice area to our firm: Economic & Complex Analytics (ECA). Our new ECA practice expands the scope of our services to encompass the evaluation of legal, scientific, and financial risks associated with environmental, mass tort, and product liability litigation. Our collective ECA expertise has been leveraged in complex insurance coverage disputes, arbitrations, Securities and Exchange Commission (SEC) reserve disclosures, financial due diligence, bankruptcy reorganizations, underlying claim evaluations, and public policy initiatives. Our experts have analyzed a diverse set of environmental and product liability risks, including many forms of environmental toxins and deleterious substances.

Marc Scarcella has fifteen years of experience as an economic consultant for mass tort litigation, specializing in quantitative methods and their applications in dispute resolution and strategic litigation management. Peter R. Kelso is an expert on mass tort and product liability litigation, specializing in data aggregation and other database management services to advise clients on litigation risk.

Roux is pleased to welcome two new Principals to our team: Marc Scarcella and Peter R. Kelso, whose extensive litigation experience is concentrated in Economic & Complex Analytics (ECA).

ECA professionals are nationally recognized for expertise in helping clients evaluate the legal, scientific, and financial risks associated with environmental, mass tort, and product liability litigation. Our experts will provide strategic consulting and expert services that assist clients to identify, quantify, forecast, and mitigate current and emerging environmental and product liability risk. Their collective expertise has been leveraged in complex insurance coverage disputes, arbitrations, Securities and Exchange Commission (SEC) reserve disclosures, financial due diligence, bankruptcy reorganizations, underlying claim evaluations, and public policy initiatives.

Mr. Scarcella and Mr. Kelso specialize in the following topics, just to name a few:

Marc Scarcella has fifteen years of experience as an economic consultant for mass tort litigation, specializing in quantitative methods and their applications in dispute resolution and strategic litigation management. Prior to joining Roux Associates, Mr. Scarcella was a Principal at Bates White Economic Consulting and a Managing Director at Analysis Research Planning Corporation.

Mr. Scarcella has acted as a consulting and testifying expert at both state and federal levels, on a number of complex insurance coverage cases. He has developed economic models for estimating potential insurance recoveries due to environmental and product liability claims. Mr. Scarcella has applied his expertise in forecasting future loss and litigation risk to the areas of asbestos, silica, pharmaceutical, medical devices, water contamination, sports-related head trauma, tobacco litigation, and various other forms of environmental toxins and deleterious substances.

Peter R. Kelso has been at the forefront of identifying emerging litigation trends for over fifteen years. Mr. Kelso is an expert on mass tort and product liability litigation. He specializes in data aggregation and other database management services to advise clients on litigation risk. He has advised Fortune 100 companies, international insurers and reinsurers, and many of the top investment firms on Wall Street on quantifying current and future potential costs associated with litigation outcomes.

Prior to joining Roux Associates as a Principal, Mr. Kelso was a Director at Bates White as well as a Vice President at Litigation Resolution Group. His expertise extends to insurance coverage negotiations, mergers and acquisitions, liability ring fencing activities, and bankruptcy reorganizations.
