In support of a national insurance carrier offering pollution liability policies, Roux Associates often performs oversight of environmental consultants contracted directly with the insured to ensure investigations and remedial activities are performed in a reasonable and cost effective manner. In one instance, while reviewing remediation plans that involved remediating an 8,000-gallon gasoline release area at an oil terminal, Roux noted that the consultant’s remediation plan included remediation of deeper soil and groundwater impacted with diesel fuel.

Roux Associates confirmed the groundwater contamination beneath the tank area to be primarily diesel impacted. Based on this information, the insurance carrier was able to limit coverage to remediation of gasoline-impacted surface soil, recovery of free product above a confining layer, and exclude all deep groundwater and soil remediation associated with an unrelated diesel release. This finding afforded the insurance carrier a cost savings of at least $500,000.
