Roux Associates Currently Has Five LSRP Licenses

Roux has provided remedial services at thousands of sites in New Jersey over the last 3 decades. As such, Roux is extremely well versed in the procedures, policies and regulations that govern its work in New Jersey. The vast majority of Roux’s work has involved the completion of PA/SI/RI/RA services under NJDEP oversight. We have enjoyed a well earned reputation with both clients and the NJDEP for conducting thorough and technically defensible work.  The May 7, 2009 signing of the Site Remediation Reform Act (SRRA) paves the way for important changes in how these types of services will be provided in the future. These changes will impose certain additional responsibilities and challenges for both clients and Roux. Similarly, these changes will present certain opportunities for both clients and Roux. Roux’s active involvement in comparable programs in other States (e.g. Massachusetts and Connecticut), upon which New Jersey’s SRRA was partially modeled, positions us well to serve the needs of our clients.

The SRRA essentially privatizes the site remediation process in New Jersey by licensing individuals to sign-off on individual steps in the remedial process as well as signing off on remedial “closure”. These licensed individuals, to be known as Licensed Site Remediation Professionals ( or LSRPs), will be subject to an extensive code of conduct, oversight by an LSRP Board, auditing by the LSRP Board, auditing of their submissions by the NJDEP and disciplinary measures.  Roux Associates currently has five LSRD licenses, 10 percent of the total issued to date. 

Clients with ongoing and new remedial projects in New Jersey also have new obligations stemming from the SRRA. These obligations include an affirmative responsibility to remediate sites, mandatory timeframes for remediation, potentially being subject to a provision known as “direct oversight” and presumptive remedy requirements for certain types of remedial actions.

Now more than ever careful selection of an environmental consulting firm and an individual LSRP will be critical to the successful completion of remedial obligations in New Jersey. Fifty LSRP licenses have been issued by the NJDEP (as of November 6, 2009), and a careful evaluation of the SRRA and its potential implications for ongoing or pending remedial activities is warranted. Clients will be well served to assess their needs sooner rather than later. Given the scope of the SRRA changes and given the uncertainty associated with the early development of this program, an individualized strategy is warranted. Roux would be happy to discuss a specific situation and help outline a customized strategy that best meets our clients’ current or future needs.
